TRAIL CLUB SIGNUP AND VOLUNTEER WAIVER

Thank you for your interest in joining the Ken Caryl Ranch Trail Club (KCTC). KCTC is a resident-only volunteer organization of hikers, runners, cyclists, and equestrians who value the community’s trails and open space.

Operating under a Memorandum of Understanding with the Master Association (MA) and a Joint Use Agreement with Willow Springs Open Space, the Trail Club supports all trail users by promoting stewardship, volunteerism, and partnership on open space issues.

Trail Club volunteers work alongside Ken-Caryl Ranch Rangers, Volunteer Trail Coordinators, MA staff, and MA committees on projects that primarily focus on improving and maintaining Ken-Caryl Ranch open space and trails. Because these activities involve work outside and the use of tools, all volunteers must review and acknowledge the applicable waiver (below) before participating.

After submission, the membership coordinator will confirm residency and agreement/waiver receipt prior to confirming a member. The member will then be added to the club’s email distribution and optionally may request to join the Facebook page (search Facebook groups for “Ken Caryl Trail Club”).

Members must agree to support the Trail Club in its efforts to promote recreation, stewardship, and volunteerism related to Open Space and adhere to KCRMA Open Space rules and trail etiquette.

The KCTC exists for the purposes of:

Being good stewards of Ken-Caryl and Willow Springs open space;
Enjoying the trail systems associated with Ken-Caryl and Willow Springs open space;
Providing community service;
Partnering with KCMA Rangers and our neighbors in Willow Springs on open space issues;
Sharing open space-related activities with like-minded neighbors and friends;
Improving and maintaining Ken-Caryl trails; and
Serving as advocates for Ken-Caryl trails and open space.

All Trail Club volunteers must agree to the Ken-Caryl Ranch Master Association Volunteer Waiver before participating in volunteer activities. These waivers include a release of liability and assumption of risk for participation in volunteer activities such as trail system maintenance, vegetation mitigation, use of tools, and other outdoor work in undeveloped or semi-developed areas.

Adult Volunteers (18+)

Adult volunteers must review and electronically sign the Ken-Caryl Ranch Master Association Adult Volunteer Waiver as part of the volunteer registration form prior to participating in Trail Club activities.

Minor Volunteers (Parent/Guardian Required)

Volunteers under the age of 18 must have a Parent or Legal Guardian review and electronically sign the Minor Volunteer Waiver within the volunteer registration form prior to participation.

This waiver includes parental consent and acknowledgment of the risks associated with volunteer activities.

Volunteer Waiver, Release of Liability & Assumption of Risk

Ken-Caryl Ranch Master Association

Adult Volunteer Waiver

1. Parties

This Waiver and Release of Liability (“Agreement”) is entered into between the undersigned volunteer (“Volunteer”) and Ken-Caryl Ranch Master Association, a Colorado nonprofit corporation (“KCRMA”).

2. Voluntary Participation

I understand that my participation in volunteer activities for KCRMA is voluntary and unpaid, and that I am not an employee or agent of KCRMA. I may discontinue participation at any time.

3. Description of Activities

Activities may include, but are not limited to:

Trail system maintenance and repair
Vegetation clearance, weed mitigation, and fire mitigation
Patrolling private trail systems for trespassing
Use of hand tools and power tools
Outdoor manual labor in undeveloped or semi-developed areas

4. Assumption of Risk

I understand that the Activities involve inherent and other risks, including risks that cannot be eliminated regardless of the care taken. These risks include, but are not limited to:

Uneven, rocky, steep, or unstable terrain
Slips, trips, falls, and falling objects
Exposure to weather conditions including heat, cold, wind, rain, snow, and lightning
Use of hand tools and power tools, including saws, trimmers, and similar equipment
Physical exertion, manual labor, lifting, bending, and repetitive motion
Exposure to wildlife, insects, plants, and environmental hazards
Interaction with members of the public or others
Delayed access to emergency or medical services

I knowingly and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with my participation.

5. Release of Liability (Negligence Included)

To the fullest extent permitted by Colorado law, I release, waive, and discharge KCRMA, its directors, officers, employees, agents, volunteers, contractors, and representatives from any and all claims or causes of action, including those arising from negligence, resulting from my participation in the Activities.

This release does not apply to claims arising from willful or wanton misconduct.

6. Indemnification

I agree to defend, indemnify, and hold harmless KCRMA from any claims, damages, losses, or expenses (including attorney fees) arising out of my actions or omissions during the Activities.

7. Medical Responsibility

I understand that KCRMA does not provide medical insurance for volunteers. I am responsible for my own medical care and certify that I am physically capable of participating in the Activities.

8. Safety Rules

I agree to follow all safety instructions, use required personal protective equipment, and report unsafe conditions or injuries immediately.

9. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Colorado, and venue for any dispute shall lie in Jefferson County District Court.

10. Acknowledgment

I acknowledge that I have read and understand this Agreement and that I am giving up substantial legal rights, including the right to sue. I agree to this Agreement voluntarily.

Minor Volunteer Waiver & Parent / Legal Guardian Agreement

(Colorado – C.R.S. §13-22-107)

1. Minor Participation

The undersigned parent or legal guardian (“Parent/Guardian”) consents to the participation of the minor named below (“Minor”) in volunteer activities with Ken-Caryl Ranch Master Association, a Colorado nonprofit corporation (“KCRMA”). Minor’s participation is voluntary and unpaid, and Minor may discontinue participation at any time.

Activities may include, but are not limited to:

Use of hand tools and power tools

Pursuant to C.R.S. §13-22-107, I, as the Parent/Guardian, hereby waive and release any and all claims that the Minor may have against KCRMA for injuries, damages, or losses arising from the Minor’s participation, including claims based on negligence, except for willful or wanton misconduct.

4. Indemnification by Parent/Guardian

I agree to defend, indemnify, and hold harmless KCRMA from any claims, damages, losses, or expenses (including attorney fees) arising from the Minor’s participation, and from any claims brought by or on behalf of the Minor.

5. Medical Authorization

I understand that KCRMA does not provide medical insurance for volunteers. I authorize KCRMA to seek emergency medical treatment for Minor if necessary and agree to be responsible for all costs incurred.

6. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Colorado, and venue for any dispute shall lie in Jefferson County District Court.

7. Acknowledgment

I acknowledge that I have read and understand this Agreement and that I am waiving substantial legal rights on behalf of myself and Minor, including the right to sue. I further represent that I am authorized by law to execute this Agreement and waive rights on behalf of Minor.

IF PARTICIPANT IS UNDER EIGHTEEN (18) YEARS OF AGE, A PARENT OR LEGAL GUARDIAN MUST READ AND SIGN BELOW: I am the parent or legal guardian of the above-named minor participant and have read the above Agreement. I give my unqualified permission and consent to the named minor’s participation as a volunteer for the Ken-Caryl Ranch Master Association (“Association”) to provide services on the Association’s recreation and open spaces, and trails, and on behalf of such minor participant, I hereby agree to be bound by the terms and conditions of this Agreement.
